Terms of Use

These terms are an agreement between you and Nuculair ("Nuculair", "we", "us") and govern your use of our website and service. If you use Nuculair for an organization, you accept these terms on its behalf and confirm you're authorized to do so. If you don't agree, don't use Nuculair.

#Who can use Nuculair

Nuculair is for professional use by organizations and adults aged 18 or over. You must give accurate account information, keep your login details secure and tell us promptly about any unauthorized use. You're responsible for everything done under your account. Paid plans may require identity verification.

#How you may use it

You may use Nuculair only for legitimate, lawful investigations, in line with our Acceptable Use Policy, which forms part of these terms. For every case, you are responsible for:

• having a lawful purpose and any consent or authority the law requires;
• complying with the privacy, data protection and other laws that apply to you and to the people you investigate;
• choosing an appropriate privacy tier.

#Not a consumer reporting agency

Nuculair is not a consumer reporting agency. You may not use Nuculair, or anything it produces, to make decisions about employment, credit, housing or tenancy, or insurance, or for any purpose covered by the U.S. Fair Credit Reporting Act or similar laws. You confirm this at the start of every case.

#Findings need your judgment

Nuculair collects information from third-party sources and uses automated analysis to connect it. Sources can be wrong, out of date or about a different person with the same name. Confidence scores, corroboration counts and the challenge step reduce errors but can't eliminate them. You are responsible for reviewing findings, confirming key links and verifying anything before you rely on it or share it.

#Plans, fees and trials

Prices and plan limits are shown on our pricing section or in your order. Fees are billed in advance, are non-refundable except where the law requires, and exclude applicable taxes. Unused monthly investigations don't roll over; purchased credits don't expire while your account is active. We may change prices with at least 30 days' notice before your next billing period.

A free trial, where offered, includes the investigations described on the pricing page and may be limited to one per organization.

#Your content and data

You keep your rights in the inputs you provide and the reports you create. You give us permission to process them to provide, secure and improve the service, as described in our Privacy Policy. You're responsible for the inputs you submit and confirm you have the right to submit them.

#Our property

Nuculair, including the software, methods, design and documentation, belongs to us and our licensors. We give you a limited, non-exclusive, non-transferable right to use it during your subscription. You may not copy, resell, reverse engineer or build a competing product from it, or access it by automated means except through an API we provide.

#Third-party sources

Nuculair draws on third-party websites, databases and services. We don't control them, aren't responsible for their content or availability, and may add or remove sources at any time.

#Confidentiality

Each of us will protect the other's non-public information with reasonable care and use it only for this agreement, except where disclosure is required by law.

#Suspension and termination

You can cancel at any time; your plan stays active until the end of the paid period. We may suspend or end your access, with or without notice, if you breach these terms or the Acceptable Use Policy, if we reasonably suspect misuse, or if the law requires it. On termination you can export your reports for 30 days, after which we may delete them.

#Disclaimers

Except as stated in these terms, Nuculair is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and accuracy of results.

#Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim relating to Nuculair is limited to the fees you paid us in the 12 months before the claim. These limits don't apply to your payment obligations, your indemnity below, or liability that can't be limited by law.

#Indemnity

You'll defend and indemnify Nuculair against claims arising from your cases, your breach of these terms or the Acceptable Use Policy, or your violation of any law or third-party right.

#Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have exclusive jurisdiction, unless the law where you live gives you a right to bring a claim elsewhere.

#Changes

We may update these terms. We'll post changes here and update the date at the top; for significant changes we'll give customers at least 30 days' notice by email. Continuing to use Nuculair after a change means you accept it.
